Sugar House LUZ report June 2009 

New Projects:

Deseret Industries proposal to move to Circuit City Building on 21st South.   Craig Ames of PGAW Architects presented the drawings to the LUZ committee on July 21st for review.  There were a number of issues discussed. 

  • The project includes purchasing the building to the south (currently vacant and for sale) that has significant historical value to Sugar House. We talked about possible changes to the project to allow the DI to still build an intake area that is covered, without destroying this historic house.  Mr. Ames agreed to take our ideas back to “the powers that be”, 
  • We also discussed adding windows, or window boxes on 21st South, and some glass block in the walls, similar to what Smith’s did when they remodeled.  The proposal will be on our August agenda. 

Woodbury Mixed-Use Project- on 13th East between Chevron and Park View II.  Derek Payne and Lance Bullen presented drawings for a five story building.  The first floor would be at the level of the Draw at Hidden Hollow.  This level will have community space, and some “incubator” space for Westminster College and small businesses. The second level would be at 13th East level, and would be for retail uses.  The three levels above would be housing for Westminster College students.  There will also be a parking terrace with about 215 spaces.  This project may be on the agenda for August.  It may be postponed until September if the petitioner has not filed an application with the city by our August meeting.  

NOTE:  at some point in the recent past, there was a proposal for two condominium buildings on this parcel.  This new project replaces that one.

There are no Sugar House projects on the Planning Commission, Board of Adjustment, etc for the month of July.  Several months back the LUZ Committee gave Salt Lake City feedback on the ambiguous and confusing language with regards to the ordinances related to utility boxes.  The following is a draft of the revised city code with regard to Ground Mounted Utility Boxes.  Please let me know if you have any comments about the proposed language.  The LUZ Committee did not get time to discuss this at the meeting.

DRAFT 7/9/2009 21A.40.160 Ground Mounted Utility Boxes:

A. Compliance with Regulations Required: All ground mounted utility boxes shall be subjectto the following regulations unless exempted within section 21A.02.050, "Applicability", ofthis title or where limited by other provisions of this title.

B.Definition; "Ground mounted utility boxes" shall mean such facilities, including pedestals,boxes, vaults, cabinets, meters or other ground mounted facilities and associated equipmentsuch as condensing units and generators that directly serve the property or local area inwhich the facility is placed, that are not primarily for transmission or distribution to otherlocations, or otherwise are customarily found in such areas.

C. Allowed Use: Ground mounted utility boxes proposed as follows, shall be allowed in all zoning districts.

1. Subterranean utility boxes located entirely on private property.

2. Subterranean utility boxes located in the public right-of-way such taht they not interfere with the public's use of the street or sidewalks.

3. Utility boxes located entirely within an enclosed building or structure.

4. Utility boxes located outside of the minimum setback area and within 5 feet of a building.

5.  Utility boxes for public facilities, buildings, uses, traffic control and parks, installed by or with permission of Salt Lake City Corporation.

D. Prohibited Use:  Utility boxes located in the public right-of-way in all zones except the E1, M-1 and M-2 zones are prohibited, except as stated in section C.2 of this chapter.

E.  Conditional Use:  Conditional use review is required for all ground mounted utility boxes not specifically addressed in sections C and D of this chapter.  Applications hsall be reviewed administratively by the Planning Director or an assigned designee subject to the following criteria:

 

1. Location: Utility boxes shall be located and designed to reduce its visual andenvironmental impacts on the surrounding properties.

2. Setbacks: The Planning Director may modify the setback of the utility box to reduce thevisual and environmental impact of the box when viewed from the street or an adjacentproperty. The setback variation will be a function of the site constraints, the size of theproposed box and the setbacks of adjacent properties and structures.

3. Screening: To the greatest extent possible, utility boxes shall be screened from view ofadjacent properties and City rights-of-way. Utility boxes and their associated screeningshall be integral to the design of the primary building on site and address crimeprevention through environmental design (CPTED) principles by maintaining solid oropaque screening materials.

4. Design: Utility box design shall reflect the urban character and pedestrian orientation ofthe area where it is located.

5. View: Location does not block views within sight distance angles of sidewalks,driveways and intersections, or hinder pedestrian or vehicular circulation on the site.

6. Certificate of Appropriateness: Any ground mounted utility box located within an areasubject to section 21A.34.020, "H Historic Preservation Overlay District", of this title shallrequire certificate of appropriateness review and approval with respect to location andscreening materials.
